Instalment orders are granted to creditors

JUDGE SETS OUT REPAYMENT SCHEDULES

THE FALLOUT from the recession hit Enniscorthy District Court last week as creditors came to court seeking instalment orders. Judge David Anderson set out schedules of payments ranging from €10 per week to €700 per month.

Orders were granted in eleven cases, mostly in the absence of those owing the money. However, one woman was present to meet proceedings personally at the courthouse in Ardcavan.

She was being pursued by the Bank of Ireland whose solicitor Peter Crean sought the 'highest possible sum' in regular instalments. After considering the woman's written statement of means, the judge decided that €10 per week was as much as she could afford.

The bank was granted two other orders. In one instance, the creditor was told to come up with €400 per month. In the other case, the bank was looking to recoup € 9,838 from a woman represented by solicitor Jane O'Flynn. The judge set the repayments at €15 per week, at which rate it will take Ms. O'Flynn's client more than 650 weeks, or twelve and a half years, to clear the debt.

The Enniscorthy credit union also took the legal route to recover amounts outstanding from members. It was given instalment orders for €150 per month and €300 per month. In a third case, the credit union's solicitor Caitriona Walsh stated that the sum owed was € 6,624. The judge set out repayments of €200 per month, implying that the matter will eventually be disposed of some time late in the year 2012.

Instalment orders were made out, too, to Friends First and credit unions in Naas and New Ross. Enniscorthy Town Council was granted €700 per month against a defaulting rate payer. The Revenue Commissioners pursued a sum of € 18,716 due from a taxpayer who must now come up with monthly instalments of €400 per month, suggesting that the file will not be closed until early in the year 2014.
