Construction company failed to comply with enforcement notices

A BLACKWATER construction company have been fined € 1500 for failing to comply with enforcement notices of Wexford County Council.

Denka Construction Ltd., Killavill House, Inch, Blackwater were also ordered to pay €800 in costs and VAT.

Enniscorthy District Court heard that the enforcement notice related to a planning permission granted for 12 houses.

The court was told that the company had failed to meet all conditions of the planning including the provision of public lighting, certification for sewers, landscaping, and surfacing of access roads. The estate was visited on July 21 2008, and the defendants said they were dealing with the issues.

The court heard last week that the majority of concerns had now been dealth with but there were still some outstanding issues.

Among the matters outstanding were certification for some underground services, some landscaping and the final surfacing of the access road.

Judge David Anderson was told that there are 12 houses constructed, five of which are still for sale. Judge Anderson noted that no development should have been carried out by the company without certification in advance of construction. Judge Anderson said the Council should have sought a planning injunction when the work commenced, rather than bringing a prosecution now when people are already living in the houses.

He convicted the company and imposed a € 1500 fine with costs and VAT.
